The Alberta Energy Regulator (AER) will hold a public hearing for a regulatory appeal of the AER decision, dated March 28, 2017, to refuse to issue an approval under section 38 of the Water Act. The hearing will be scheduled after requests to participate are filed.
Description of the Proceeding
On April 3, 2017, the AER received a request for a regulatory appeal, under Division 3 of the Responsible Energy Development Act and Part 3 of the Alberta Energy Regulator Rules of Practice (Rules of Practice), of the AER’s decision to refuse to issue Inter Pipeline Ltd. an approval under section 38 of the Water Act.
The purpose of the hearing is to determine whether the AER should confirm, vary, suspend, or revoke its decision.
Description of the Application
On October 19, 2016, Inter Pipeline Ltd. applied for an approval to construct an instream rock sill and to armour the bank of the Red Deer River in the east half of Section 7, Township 22, Range 12, West of the 4th Meridian, approximately 35 km north of Brooks, Alberta. The project would increase the depth of cover over three of the applicant’s pipelines.

How can I apply to participate in the hearing?
Inter Pipeline Ltd. and the AER’s Pipeline Authorizations Group are parties to this regulatory appeal.
If you are not already a party to the regulatory appeal and wish to participate in the hearing, you must file a written request to participate.
Your request to participate must include the information set out under section 32.1(2) of the Alberta Energy Regulator Rules of Practice (Rules of Practice).
Send the request to the hearing coordinator. Submissions should be PDF documents with bookmarks, page numbers (with the first page in the document being numbered page one), and optical character recognition.

July 21, 2017 - Final date to submit responses to any request to participate.
Is this a public process?
Yes. Section 49 of the Rules of Practice requires that all documents and information filed for a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.
