Conditions in Alberta Energy Regulator Approvals Relating to Participation in the Cumulative Environmental Management Association

The purpose of this bulletin is to advise approval holders of recent changes relating to the operation of the Cumulative Environmental Management Association (CEMA) and the impact of those changes on terms and conditions in approvals granted under the Environmental Protection and Enhancement Act.

Effective April 1, 2016, CEMA announced it has ceased operations.

As a result of CEMA ceasing operations, effective immediately and until further notice, the Alberta Energy Regulator (AER) considers any term or condition of any AER approval that mandates participation in CEMA as inoperative insofar as it requires participation in or funding of CEMA. To the extent any term or condition of any AER approval requires any action beyond CEMA participation, funding, or both, the operational intent of the term or condition survives but without the requirement to undertake the intent of the condition through CEMA. For greater clarity, where a term or condition of an AER approval requires monitoring, reporting, research, or any other action to be taken by an approval holder, the requirement for such monitoring, reporting, research, or other action in that term or condition remains in full force and effect but is not required to be fulfilled through CEMA or using CEMA or its resources.
