Notice Of Application for a Term Licence Amendment for Interbasin Transfer of Water
The Alberta Energy Regulator (AER) has received Water Act application 34205730.
This notice also sets out the deadline for filing statements of concern on the application. See the section below on how to file a statement of concern and for filing dates.
Description of the Application
Notice is given that Parallax Energy Operating Inc. has filed an application under the provisions of the Water Act for an amendment to Licence No. 00458425 to change/expand the Point of Use (operating area). The proposed amendment will result in a lower risk inter-basin transfer of water from the South Saskatchewan River Basin (Blindman River sub-basin) to the North Saskatchewan River Basin (Battle River sub-basin).
No changes proposed to the point of diversion, Blindman River in NE 03-040-01W5M, the diversion volume 1,000,000 cubic metres per year, or the rate of diversion 0.5 cubic metres per second, are requested.
The purpose of the water use remains unchanged as drilling and hydraulic fracturing and association operations.

Filing a Statement of Concern
Statements of concern for non - expedited applications must be filed by October 24, 2026, 11:59 p.m.
Statements of concern for expedited applications must be filed by October 24, 2026, 11:59 p.m. or before a decision is made on the application, whichever is sooner. Decisions may be made immediately or on an expedited basis for applications identified as expedited in this integrated application.
A person who believes that they may be directly and adversely affected by this application may file a statement of concern with the Regulator in respect to this application.

Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Land and Property Rights Tribunal (formerly the Surface Rights Board).
Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
