Request for Regulatory Appeal

Anyone requesting an appeal must follow the timelines outlined in our legislation, such as the Alberta Energy Regulator Rules of Practice. We have summarized some of the appeal deadlines in the table below. When reviewing whether a request for regulatory appeal was filed on time, we rely on the deadlines provided in our legislation. Every decision we issue is governed by provincial legislation. We decide on approvals for licences, leases, authorizations, and certificates.

Orders issued under the following sections of Coal Conservation Act:

  • Section 20 - cancel or suspend a permit or licence
  • Section 25 - shut down a processing plant
  • Section 31.6(1) - suspend or cencel an approval or licence for an in situ coal scheme

Environmental Protection and Enhancement Act
Enforcement orders issued under section 210(1)(a), (b), or (c) of the Environmental Protection and Enhancement ActAny eligible person*No later than 7 calendar days after notice of the enforcement order is issued
Environmental protection orders issued under sections 129, 140, or 141 of the Environmental Protection and Enhancement ActAny eligible person*No later than 7 calendar days after notice of the environmental protection order is issued

Oil and Gas Conservation Act

Orders issued under the following sections of the Oil and Gas Conservation Act:

  • Section 27 - suspend or abandon a well or facility
  • Section 30 - payment of costs regarding suspension, abandonment, remediation, or reclamation
  • Section 44 - shut down or close a well or facility

Oil Sands Conservation Act

Orders issued under the following sections of the Oil Sands Conservation Act:

  • Section 9 - stop order
  • Section 15 - cancel an approval if the order was made without a hearing

Pipeline Act

Orders issued under the following sections of the Pipeline Act:

  • Section 23 - discontinuation or abandonment of a pipeline
  • Section 26 - payment of the discontinuation or abandonment costs
  • Section 29 - suspension of operation or construction of a pipeline

Public Lands Act

* An eligible person is

  • any person who is directly and adversely affected by a decision of the AER under an energy resource enactment,
  • any person who is permitted under the specified enactments to file a notice of appeal under those enactments, or
  • any other person described in the regulation
