Regulatory Appeal of Administrative Penalty issued July 11, 2024
The Alberta Energy Regulator (AER) will hold a written hearing for a regulatory appeal of an administrative penalty issued under section 237(1) of the Environmental Protection and Enhancement Act (EPEA), on July 11, 2024. Oral final arguments will be held virtually on June 18, 2025, and webcast at https://www.meetview.com/aer2025/player/.
The AER issued a notice of hearing on February 12, 2025, and did not receive any requests to participate in response to that notice.
Description of the Proceeding
On July 11, 2024, the AER Regulatory Compliance branch issued an administrative penalty to Canadian Natural Resources Limited for failure to store a hazardous substance in a manner that ensured that the hazardous substance did not directly or indirectly come into contact with any animals, contrary to section 155 of the EPEA. The incident occurred at Horizon Oil Sands Processing Plant and Mine, Tar River Valley, located at 10-31-096-12W4M; approximately 60 kms north of Fort McMurray in the Regional Municipality of Wood Buffalo.
On August 9, 2024, the AER received a request for regulatory appeal, per s 38 the Responsible Energy Development Act (REDA) and Part 3 of the Alberta Energy Regulator Rules of Practice (Rules of Practice).
The AER granted the request for the regulatory appeal on December 10, 2024.
The purpose of the hearing is to determine whether the AER should confirm, vary, suspend, or revoke its decision to issue the penalty.
