Regulatory Appeals of an RCAM order and an Abandonment and Reclamation Order
The Alberta Energy Regulator (AER) will hold a public hearing for regulatory appeals of the decisions to issue a Reasonable Care and Measures (RCAM) Order and an Abandonment and Reclamation order to Sunshine Oilsands Ltd. (Sunshine) at the AER’s Govier Hall, 250 5th Street SW, Calgary Alberta, starting on May 26, 2026, at 9:00 a.m. The hearing will be videocast at https://www.meetview.com/aer2026/.
Should members of the public choose to observe the hearing in-person they should be aware that they may be captured in the live stream video.
The live stream video of the hearing will not be recorded and will not be available for viewing later. The transcripts are the official record of the hearing and will be posted on the AER’s website.
The AER issued notices of hearing on August 14, 2025. All parties must be present to register at the start of the hearing. If the requests for regulatory appeal are withdrawn, the hearing will be cancelled.
Description of the Proceeding
On November 20, 2024, the AER received a request for regulatory appeal of the AER’s decision to issue an RCAM order under sections 22, 26.2, and 27 of the Oil and Gas Conservation Act, section 1.100 of the Oil and Gas Conservation Rules, and sections 22.1 and 23 of the Pipeline Act to Sunshine on November 14, 2024.
On May 15, 2025, the AER received a request for regulatory appeal of the AER’s decision to issue an Abandonment and Reclamation order under section 27 of the Oil and Gas Conservation Act, section 23 of the Pipeline Act, and sections 140 and 241 of the Environmental Protection and Enhancement Act on May 9, 2025.
The AER granted the requests for regulatory appeal on June 5, 2025, and June 24, 2025, respectively.
The purpose of the hearing is to determine whether the AER should confirm, vary, suspend, or revoke its decisions to issue the orders.
