The Alberta Energy Regulator (AER) will hold a public hearing of related applications 33571576 (Tourmaline Oil Corp.), 1958059 (TykeWest Limited), and 1959278 (Northrock Resources Partnership Ltd.). This notice sets out how to request to participate in the hearing. The hearing will be scheduled after requests to participate are filed. If there are no participants, the AER may cancel the hearing and decide on the applications without further notice.

The AER’s decision that the applications should be decided by a panel of hearing commissioners is available on the Participatory and Procedural Decisions landing page on https://www.aer.ca/.

Description of the Applications
On July 15, 2025, Tourmaline Oil Corp. (Tourmaline) applied under the Pipeline Act and Directive 056: Energy Development Applications and Schedules to amend pipeline licence 62758-5 regarding the pipeline located at Legal Subdivision 05 of Section 09, Township 055, Range 03, West of the 6th Meridian (05-09-055-03W6M) to 14-09-058-02W6M. 

The amendment proposes:

  • changing the licensed substance from sour natural gas (70 mol/kmol H2S) to sweet natural gas (0 mol/kmol H2S)
  • reducing the Emergency Planning Zone to 0 kilometres
  • decreasing the setback to the pipeline right of way
  • changing the pipeline category type to non-sour service natural gas 

Both TykeWest Limited (TykeWest) and Northrock Resources Partnership Ltd. (Northrock) filed statements of concern in respect of Tourmaline’s amendment application.

On June 14, 2025, TykeWest applied under sections 48, 55, and 56 of the Oil and Gas Conservation Act (OGCA) and section 1.3 of Directive 065 Resources Applications for Oil and Gas Reservoirs (D065) for an order declaring Tourmaline to be a common carrier of gas produced from the Cabin Creek Dunvegan and Charlie Lake pools (application 1958059). TykeWest’s application proposes a common carrier order applicable to the gas gathering system from the compressor at 05-09-055-03W6M to 14-09-058-02W6M, with the produced natural gas ultimately transported to the Pembina Kaybob Gas Plant No. 3 at 03-15-09-18W5.

On October 1, 2025, Northrock applied under section 48 of the OGCA and section 1.3 of D065 for an order declaring Tourmaline to be a common carrier of gas produced from the Cabin Creek Dunvegan and Charlie Lake pools (application 1959278). Northrock’s application proposes a common carrier order applicable to the gas gathering system from the compressor at 05-09-055-03W6M to 14-09-058-02W6M, with the produced natural gas ultimately transported to the Pembina Kaybob Gas Plant No.3 at 03-15-09-18W5.

How can I apply to participate in the hearing?
You must file a written request to participate, even if you have already filed a statement of concern with the AER. Requests to participate are placed on the public record of this proceeding.

Your request to participate must contain

  1. a copy of your statement of concern or an explanation why you did not file one;
  2. a concise statement indicating
    1. why and how you may be directly and adversely affected by the AER’s decision on the applications, or
    2. if you will not be directly and adversely affected by a decision on the applications, explain
      • what the nature of your interest in the matter is and why you should be permitted to participate,
      • how your participation will materially assist the AER in deciding the matter that is the subject of the hearing,
      • how you have a tangible interest in the subject matter of the hearing,
      • how your participation will not unnecessarily delay the hearing, and
      • how you will not repeat or duplicate evidence presented by other parties;
  3. the outcome of the applications that you advocate;
  4. the nature and scope of your intended participation;
  5. your contact information;
  6. if you are acting on behalf of a group or association of people, the nature of your membership in the group or association; and
  7. your efforts, if any, to resolve issues associated with the proceeding directly with the applicant.

Send one copy of the request to Tourmaline, TykeWest, and Northrock, and one copy to the hearing coordinator. Submissions should be PDF documents with bookmarks, page numbers (with the first page in the document being numbered page one), and optical character recognition.

March 26, 2026    Final date for response from the applicants on any requests to participate.

Is this a public process?
Yes. Section 49 of the Rules of Practice requires that all documents and information filed for a proceeding be placed on the public record. You must not include any personal information that you do not want to appear on or are not authorized to put on the public record. You should assume that anything you submit will be available online to the public. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.

If my request to participate is approved, can I apply to get reimbursed for hearing-related costs?
If you are participating in a hearing, you may be eligible to have some of your costs paid. Directive 031: REDA Energy Cost Claims explains how and when to apply.

What is outside of the AER’s jurisdiction?
Compensation for land use is not dealt with by the AER and should be referred to the Land and Property Rights Tribunal (formerly the Surface Rights Board).

Alberta’s consultation with Alberta’s First Nations, Metis settlements, and Credibly Asserted Métis communities, and assessment of its adequacy are managed by the Aboriginal Consultation Office.
