Release Date
Today, we released a new edition of Directive 011: Estimated Liability. We made the following administrative changes and clarifications:
- Clarified definition of inactive facilities to align with existing requirements (section 3).
- Provided more information and clarification on the OneStop liability assessment report, including a new appendix 4, to ensure that licensees are aware of and know how to access the information available to them within the report and recognize that it is the licensee’s responsibility to ensure that the report is correct and up to date (sections 4, 8.1.3, and 9 and appendix 4).
- Clarified well depth in estimating well abandonment liability (section 5.1.1).
- Clarified that a licensee must receive confirmation from the AER that site-specific liability assessment was received before submitting a new, amendment, or transfer application (section 6.1).
- Section 9, “Orphan Fund,” was reorganized to further clarify the two types of levies administered by the AER.
