The Alberta Energy Regulator (AER) has received Environmental Protection and Enhancement Act (EPEA) applications 001-00509601 and 015-00010404, Water Act (WA) applications 008-00210935 and 010-00157408, and Coal Conservation Act (CCA) application 1958300 from Capital Power Generation Services Inc. (CPC) for a reclamation certificate and amendments to the EPEA Approval boundary, WA Fenceline and Mine Dewatering Approval boundaries, and the CCA Mine Licence boundaries of the Genesee Mine (Mine No. 1788).

The AER is reviewing the applications together with the supporting documents.

This notice also sets out the deadline for filing a statement of concern on these applications. See the section below How to File a Statement of Concern. 

Description of the Applications
CPC has applied for the Genesee Mine No. 1788:

  • Under EPEA for:
    • A reclamation certificate for approximately 259 hectares of land located in the following legal land descriptions:
          N ½ 3-050-02-W5
          S ½ 10-050-02-W5
    • An amendment to the EPEA Approval No. 10404-03-00 boundary to remove the following legal land descriptions:
          N ½ 3-050-02-W5
          S ½ 10-050-02-W5
  • Under WA for:
    • An amendment to WA Fenceline Approval No. 157408-00-00, as amended, boundary to remove the following legal land descriptions:
          N ½ 3-050-02-W5
          S ½ 10-050-02-W5
    • An amendment to the WA Mine Dewatering Approval No. 210935-00-00, as amended, boundary to remove the following legal land descriptions:
          N ½ 3-050-02-W5
          S ½ 10-050-02-W5
  • Under CCA for:
    • An amendment to CCA Mine Licence C 2005-12K boundary to remove the following legal land description:
          S ½ 10-050-02-W5

The Genesee mine is located in portions Townships 50 and 51, and Ranges 2 and 3, West of the 5th Meridian, about 20 km north of Warburg, Alberta, as detailed in the application materials.

Requirement to File a Statement of Concern 
If you have concerns with this application, you must file a statement of concern as described below. If you do not file a statement of concern, the AER may approve the application without further notification. 

How to File a Statement of Concern
For your submission to be considered a valid statement of concern, it must be filed by 11:59 p.m. on the filing date below. Send one copy of your statement of concern to the applicant at the name and address above and one copy either online via the AER’s web-based form or by mail or email:

August 08, 2025    Final date to file a statement of concern. 

Contents of a Statement of Concern
For your submission to be considered a valid statement of concern, it must include:
     a) why you believe that you may be directly and adversely affected by a decision of the AER on the application; 
     b) the nature of your objection to the application;
     c) the outcome of the application that you advocate;
     d) the location of your land, residence, or activity in relation to the location of the energy resource activity that is the subject of the application; and 
     e) your contact information, including your name, address in Alberta, telephone number, and e-mail address or, if you do not have an e-mail address, your fax number.

The AER also requests that you include the application number in your statement of concern.

Confidentiality
Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. The Rules of Practice is available on the AER website at www.aer.ca.

Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Alberta Surface Rights Board.

Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of Aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
