The Alberta Energy Regulator (AER) will hold a public hearing of applications 1614037, 1784753, 1809825, 1928016 , 1928017, 1928430, 30602032, 30608918, 30608934. This notice sets out how to request to participate in the hearing. The hearing will be scheduled later or, if there are no participants, the AER may cancel the hearing and decide on the applications without further notice.

Description of the Applications

  • Pure Environmental Waste Management Ltd. (Pure) has applied under the Oil and Gas Conservation Rules (OGCR) in accordance with Directive 056: Energy Development Applications and Schedules for a licence to drill one horizontal sweet disposal well with zero H2S into the Keg River Formation located at surface location LSD 07, Section 20, Township 085, Range 09, West of the 4th Meridian (07-20-085-09W4M) to bottomhole location 07-16-085-09W4M (proposed 07-16 disposal well) and one horizontal sweet disposal well with zero H2S at surface location 10-25-085-10W4M to bottomhole location 09-19-085-09W4M (proposed 09-19 disposal well).
  • Pure has applied under the Oil and Gas Conservation Act (OGCA) and AER Directive 065: Resources Applications for Oil and Gas Reservoirs for a new disposal scheme to dispose of Class II and Ib fluids into the Keg River Formation located at the proposed 7-16 disposal well and the proposed 09-19 disposal well.
  • Pure has applied under the Public Lands Act (PLA) to use public land in order to construct and operate a Mineral Surface Lease (MSL) Wellsite - Disposal at the proposed 07-16 disposal well.
  • Pure has applied under the PLA to use public land as well as the Pipeline Act in accordance with Directive 056,for a licence to construct and operate an in-ground produced water pipeline from the oilfield waste management facility located at 10-25-085-10W4M (the facility) to a pipeline tie-in at the proposed 07-16 disposal well, and for a licence to construct and operate a fresh water (application needs to be amended to salt water not fresh water) pipeline from the proposed 07-16 disposal well to a pipeline tie-in at the facility. Pure has also applied for an additional licence to construct and operate a pipeline to connect a Grande Rapids Formation saline water source well from Pure's existing water well located at the facility to wash caverns.
  • Pure has applied under the PLA and Directive 058 – Addendum 2015-01-14: Oilfield Waste Management Facility Approvals - Notification and Amendment Procedures to amend the existing facility, access road and accept imported oilfield waste streams. 
  • The project would be located in the Lower Athabasca region, about 25 to 40 km south of Fort McMurray, Alberta. See table 1 at the end of this notice for a summary of the applications.

How can I apply to participate in the hearing?

You must file a written request to participate, even if you have already filed a statement of concern with the AER. Requests to participate are placed on the public record of this proceeding.
Your request to participate must contain

  1. a copy of your statement of concern or an explanation why you did not file one;
  2. a concise statement indicating
    1. why and how you may be directly and adversely affected by the AER's decision on the application, or
    2. if you will not be directly and adversely affected by a decision on the application, explain
      • what the nature of your interest in the matter is and why you should be permitted to participate,
      • how your participation will materially assist the AER in deciding the matter that is the subject of the hearing,
      • how you have a tangible interest in the subject matter of the hearing,
      • how your participation will not unnecessarily delay the hearing, and
      • how you will not repeat or duplicate evidence presented by other parties;
  3. the outcome of the application that you advocate;
  4. the nature and scope of your intended participation;
  5. your contact information;
  6. if you are acting on behalf of a group or association of people, the nature of your membership in the group or association; and
  7. your efforts, if any, to resolve issues associated with the proceeding directly with the applicant.

Is this a public process?

Yes. Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed for a proceeding be placed on the public record. You must not include any personal information that you do not want to appear on or are not authorized to put on the public record. You should assume that anything you submit will be available online to the public. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.

If my request to participate is approved, can I apply to get reimbursed for hearing-related costs?

If you are participating in a hearing, you may be eligible to have some of your costs paid. Directive 031: REDA Energy Cost Claimsexplains how and when to apply.

What is outside of the AER's jurisdiction?

Compensation for land use is not dealt with by the AER and should be referred to the Alberta Surface Rights Board.

Crown consultation with Alberta's First Nations and Métis settlements and assessment of its adequacy are managed by the Aboriginal Consultation Office.
