Section 106(1) Declarations
The Alberta Energy Regulator (AER) will hold an electronic prehearing meeting at 10:00 a.m. on September 3, 2020, for regulatory appeals 1928568 and 1928569. Written submissions for the prehearing meeting were received from Darren O’Brien and Jeffrey Young (Requesters) on August 5, 2020, and August 19, 2020, and from the AER’s Closure and Liability Management Branch (CLM) on August 12, 2020.
The public will be able to follow the prehearing meeting on our webcast. Information for accessing the webcast and any scheduling updates will be posted on www.aer.ca on the hearings page.
What is the purpose of the meeting?
The purpose of the prehearing meeting is to determine procedures for the hearing and decide any other matters that may aid with simplification of the proceeding and its fair and most expeditious disposition. Evidence or argument on the merits of the regulatory appeals will not be considered in the prehearing meeting process.
Description of the Proceeding
On May 4, 2020, the AER decided to conduct a hearing on the requests for regulatory appeal of CLM’s decision to issue declarations under section 106(1) of the Oil and Gas Conservation Act naming the Requesters.
The purpose of the hearing is to determine whether the AER should confirm, vary, suspend, or revoke its decision to issue the declarations. If the requests for regulatory appeal are withdrawn, the hearing will be cancelled.
The prehearing meeting is open to the public to watch. Participation is limited to the above parties.

Is this a public process?
Yes. Section 49 of the Alberta Energy Regulator Rules of Practice requires that all documents and information filed for a proceeding be placed on the public record. You must not include any personal information that you do not want to appear on or are not authorized to put on the public record. You should assume that anything you submit will be available online to the public. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.
